Mountain Comfort Cabin Rentals

These Terms & Conditions ("Terms") govern your access to and use of MountainComfortCabins.com (the "Site") and any booking, rental, or related services offered by Mountain Comfort Cabin Rentals ("Mountain Comfort Cabin Rentals," "we," "us," or "our"). By accessing the Site, making a reservation, or otherwise using our services, you ("you," "guest," or "user") agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or our services.
These Terms should be read together with our Privacy Policy (available at mountaincomfortcabins.com/privacy-policy) and our SMS Terms & Conditions (available at mountaincomfortcabins.com/sms), each of which is incorporated into these Terms by reference.
1. Website Use and Acceptable Conduct
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
• Use the Site in any way that violates any applicable local, state, national, or international law or regulation;
• Attempt to gain unauthorized access to the Site, our servers, or any systems or networks connected to the Site;
• Interfere with or disrupt the operation of the Site or the servers or networks used to make it available;
• Use any automated means, including bots, scrapers, or spiders, to access or collect data from the Site without our prior written consent;
• Upload or transmit any viruses, malware, or other harmful code;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity; or
• Use the Site to submit false, misleading, or fraudulent booking requests or information.
We reserve the right to restrict or terminate your access to the Site at our discretion, without notice, if we believe you have violated these Terms.
2. Intellectual Property and Copyright
All content on the Site, including text, graphics, logos, images, photographs, property descriptions, and software, is the property of Mountain Comfort Cabin Rentals or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
You may view, download, and print content from the Site solely for your own personal, non-commercial use in connection with evaluating or booking a stay with us. You may not reproduce, distribute, modify, publicly display, republish, or create derivative works from any content on the Site without our prior written permission.
The "Mountain Comfort Cabin Rentals" name and logo are trademarks of Mountain Comfort Cabin Rentals. You may not use our name, logo, or branding without our prior written consent.
3. Booking / Rental Terms and Cancellation Policy
3.1 Reservations. All reservations are subject to availability and our acceptance. A reservation is not confirmed until you receive a booking confirmation from us and, where applicable, we have received full or partial payment as described in these Terms.
3.2 Eligibility. The primary guest making the reservation must be at least 18 years of age, and certain properties may require a higher minimum age (as specified on the applicable property listing). The primary guest must be present for the entirety of the stay and is responsible for all members of their party.
3.3 Occupancy and Use. Properties may be used only for the number of guests disclosed at the time of booking and may not exceed the posted maximum occupancy for that property. Properties are intended for residential vacation use only; commercial use, events, parties, and gatherings not disclosed and approved in advance are prohibited.
3.4 Cancellation Policy. If you cancel a reservation 30 or more days before the scheduled check-in date, you will receive a full refund of amounts paid, less any applicable cancellation or processing fee disclosed at the time of booking. Cancellations made less than 30 days before check-in are not eligible for a refund, except where required by law or otherwise stated in writing by us. We recommend guests consider optional travel/damage insurance, if offered, to protect against unforeseen circumstances.
3.5 Modifications and No-Shows. Changes to reservation dates or properties are subject to availability and may result in a rate adjustment. Failure to check in without prior cancellation (a "no-show") will be treated as a cancellation subject to Section 3.4 and does not entitle you to a refund.
3.6 Check-In / Check-Out. Check-in and check-out times, and any related instructions or access codes, will be provided prior to your stay. Early check-in or late check-out is subject to availability and may incur an additional fee.
3.7 Property Rules. Guests must comply with all posted property rules, including any restrictions on smoking, pets, noise, occupancy, and parking. Violation of property rules may result in immediate termination of the stay without refund.
4. Payment Terms and Applicable Fees
4.1 Rates and Fees. Rates displayed on the Site are subject to change until a reservation is confirmed. In addition to the nightly rate, your total may include applicable cleaning fees, service or processing fees, taxes, and any optional add-ons you select.
4.2 Payment Schedule. We may require a deposit at the time of booking, with the remaining balance due prior to check-in, as disclosed during the booking process. Payments are processed through our third-party payment processor; by submitting payment, you represent that you are authorized to use the payment method provided.
4.3 Security Deposit. Certain reservations require a refundable security deposit, which will be returned after check-out, less any amounts reasonably deducted for damage, excessive cleaning, missing items, smoking violations, or other breaches of the property rules or these Terms, as determined by us in good faith.
4.4 Taxes. Applicable state and local occupancy or sales taxes will be added to your total reservation cost as required by law.
5. Disclaimers and Limitation of Liability
THE SITE AND ALL INFORMATION, CONTENT, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT PROPERTY DESCRIPTIONS, PHOTOGRAPHS, OR AVAILABILITY WILL BE ACCURATE AT ALL TIMES.
Vacation rental properties may include amenities such as pools, hot tubs, decks, fire pits, wooded surroundings, and recreational equipment that carry inherent risks. You acknowledge and assume these risks, and agree to supervise children and other members of your party accordingly.
TO THE FULLEST EXTENT PERMITTED BY LAW, MOUNTAIN COMFORT CABIN RENTALS, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR YOUR STAY AT ANY PROPERTY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR RESERVATION SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE RESERVATION GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
6. Indemnification
You agree to indemnify, defend, and hold harmless Mountain Comfort Cabin Rentals and its owners, officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your use of the Site; (b) your reservation or stay at any property; (c) your violation of these Terms or any property rules; or (d) your violation of any rights of a third party, including any damage caused to a property or its contents by you or a member of your party.
7. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to them, the Site, or your reservation shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict-of-laws principles.
Any dispute arising out of or relating to these Terms, the Site, or a reservation that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Sevier County, Tennessee, and you consent to the personal jurisdiction of such courts. Before initiating any formal proceeding, you agree to first contact us at the information in Section 12 to attempt to resolve the dispute informally.
8. User Accounts and Security
Certain features of the Site, such as guest and owner portals, may require you to create an account or use login credentials provided by us or our property management platform. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to notify us immediately at info@mountaincomfortcabins.com of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to safeguard your account credentials.
9. Third-Party Links and Services
The Site may contain links to, or integrate with, third-party websites and services, including our property management software, payment processors, booking and channel management platforms, and attraction/ticket providers (such as our free attractions program). These third-party services are governed by their own terms and privacy policies, and we are not responsible for the content, accuracy, or practices of any third-party site or service.
Your use of any third-party service linked from or integrated with the Site is at your own risk and subject to that third party's terms.
10. General Provisions
10.1 Entire Agreement. These Terms, together with our Privacy Policy, SMS Terms & Conditions, and any property-specific rules or rental agreement provided at the time of booking, constitute the entire agreement between you and Mountain Comfort Cabin Rentals regarding the Site and your reservation, and supersede any prior agreements.
10.2 Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
10.3 Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
10.4 Assignment. You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms without restriction.
10.5 Force Majeure. We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, severe weather, government action, or other events of force majeure.
10.6 Changes to These Terms. We may update these Terms from time to time. Any changes will be posted on this page with a revised effective date. Your continued use of the Site or our services after changes take effect constitutes your acceptance of the revised Terms.

Rental Policies
Mountain Comfort Cabin Rentals has adopted the following Rules and Regulations pertaining to the use of the cabin in order to enable the guests to obtain the maximum enjoyment from the use, as well as securing the investment of the cabin owner's property.
SHORT-TERM LEASE AGREEMENT
Agent and Owner agree to lease the Premises to Guest for the term specified above and on the terms and conditions set forth herein. This short-term lease agreement ("Lease") is entered by the undersigned Guest ("Guest") and Mountain Comfort Cabin Rentals ("Agent") as manager for the owner ("Owner") of the cabin/condo/property ("Premises"). It is expressly acknowledged, and agreed, by the parties hereto that the Premises are being leased on a short-term basis as a vacation rental. If necessary, all questions and communication can be mailed to 234 Circle Dr 3105, Gatlinburg, TN 37738.
RESERVATIONS
You must be at least 18 years of age to book a cabin with Mountain Comfort Cabin Rentals. NO HOUSE PARTIES. All cabins are NON-SMOKING and will result in a fine of up to $500 if it is found that the cabin has been smoked in. Rates are subject to change at any time. A deposit of half (50%) of your stay is due at time of booking. We accept Visa, MC, Discover, & Amex. The remaining balance is due 15 days prior to arrival. No portion of the deposit is held in escrow. Guests hereby authorize Agent to charge any expenses related to repairs, extra cleaning, or theft/ vandalism of any property from the unit to the guest's credit card on file. Property will be replaced at current retail value plus $35 service fee. An inspection of the unit is taken before check-in and after check out. Upon arrival to your unit, please inspect the unit and report any problems within 1 hour. Pursuant to the provisions of the Tennessee Code Annotated, Title 47, Chapter 18 and Title 62, Chapter 13, Section 62-13-104(b)(3), Subdivision (D)(i) Mountain Comfort Cabin Rentals discloses the following as policy: "All advance rent deposits, damage fees, taxes, and balance of rent due are deposited into a bank rental operating account. These deposits are considered earned income to Mountain Comfort Cabin Rentals upon receipt and may be used immediately. Any refunds are disbursed from the general fund of Mountain Comfort Cabin Rentals.
TRAVEL INSURANCE
We recommend the purchase of Travel Insurance for all planned vacations. Travel Insurance will protect your investment in case of covered events that are out of your control. Travel Insurance is good to have in case you must unexpectedly cancel your trip for a covered reason. If you become sick or injured on your trip Emergency Assistance, Transportation services, and Dental coverage are part of the Trip Insurance, and can reimburse expensive costs you could incur. Our cancellation policy does not allow us to issue refunds for the vacation rental if you cancel your reservation within 30 days of your scheduled arrival. Mountain Comfort Cabin Rentals offers Travel Insurance through CSA Travel Protection, which can reimburse your unused, non-refundable, prepaid trip costs if you are forced to cancel for a covered reason.
PET POLICY
If a pet is found in a non-pet friendly cabin a fine of up to $250 cleaning fee will be charged to guest and guest will be escorted from the property immediately. All money paid by guest will be forfeited.
CHECK IN/OUT
All reservations must be paid in full 15 days prior to arrival. If your credit card is declined and we cannot contact you, your reservation may be cancelled, and all money forfeited. Check-in begins at 4:00 PM EST. Check out is 10:00 AM EST. You will be billed at $25 per half hour if not vacated by 10:00 AM EST. Any guest not checked out by 12:00 PM EST will be charged for an extra day. Upon check-out, guests understand and agree to perform the following before vacating: Place all dirty dishes in dishwasher and start the machine or wash by hand. A minimum of $50 will be charged for excessive cleaning. Place all trash in receptacle, secure hot tub lid, LOCK ALL DOORS AND WINDOWS. Mountain Comfort Cabins will not be responsible for any items left in the cabins by the Guest; however, please contact us and we will try to mail any items left behind to you, at your expense.
Free Activities Included with your stay: As a thank you for staying with Mountain Comfort Cabin Rentals, you will receive complimentary admissions to popular local attractions every day of your stay. Be on the lookout for emails from Xplorie that will explain how it all works, available activities and how to redeem your complimentary admissions. Please add hello@fun.xplorie.com to your contacts to ensure message delivery. Only valid for short-term stays.
Damage Waiver Fee:
A damage waiver fee will be applied to all reservations which will assist in covering accidental damages. The fees and covered amounts vary by bedroom as follows:
1 bedroom - $39 assisting in up to $350 in accidental damages
2 bedrooms - $49 assisting in up to $450 in accidental damages
REFUNDS
Mountain Comfort Cabin Rentals is a property management company. All cabins are privately owned. Unfortunately, we cannot refund any money or relocate guests due to any of these: TV, VCR, DVD, gas log fireplace, jetted tub, hot tub, pool table, gaming system, small appliances, etc. not working or malfunctioning. No refunds will be given for acts of God, loss of electrical power, water, air conditioning, or cable/satellite outages. Refunds will not be given for ANY REASONS after check-in. In the event of a mechanical failure, we will make every effort to have all reported malfunctions corrected as promptly as possible during regular business hours. No refunds for early departure; this includes departures due to inclement weather.
ARBITRATION
Guest hereby agrees to settle any disputes and/or legal complaints arising under, or related to, this contractual agreement through the process of arbitration. Guest agrees to waive the right to sue and/or participate in class-action lawsuits against Mountain Comfort Cabin Rentals. Furthermore, Guest agrees to pay all costs, expenses, and attorney's fees, as allowed by Tennessee State Law, expended or incurred by Owner or Agent due to any default or breach by Guest of any of the terms of this Lease.
INSECTS
Welcome to the Smoky Mountains. Our cabins are neighbors to the National Park. Your vacation home is treated once a month for insects. Most of our cabins are in wooded, mountainous environment, and we cannot guarantee them to be free of pests, bugs, or animals. We do not give refunds for pests, bugs, or animals. Should it arise, we will take appropriate measures to correct the problems. You may want to bring wasp spray during spring/summer months.
DRIVING CONDITIONS
Mountain roads can be rough at any time of the year. We do not guarantee any road surface conditions. Most roads in our area are well maintained; however, some are curvy and steep, and some are gravel. In the fall, winter, and early spring it is not uncommon to occasionally have hazardous road conditions. It is strongly suggested that all guests during these seasons have 4-wheel drive vehicles or snow chains on their tires. No refunds will be given due to inability to get to cabin due to road conditions including ice & snow. You are responsible for your transportation. We cannot provide transportation, nor are we responsible for any towing charges you may incur during your stay.
HOUSEKEEPING / TRASH PICK UP
Your vacation rental was cleaned prior to your arrival. Please call our office immediately to report any housekeeping issues. We will correct the problem as soon as possible. No refunds are given. If you have more trash than will fit in the outside trash receptacle, please call for trash pickup.
HOT TUBS/POOLS
Please consult a physician if you have any questions or concerns regarding use of hot tubs or pools. Hot tubs are drained and cleaned between each guest stay. Hot tubs have bromine tablets in them. We are not responsible for any jewelry or clothing damage if worn in the hot tub. A shower should be taken before and after entering the hot tub per guidelines of Sevier County Health Department. Any damage to the hot tub cover will result in a charge of $400. The covers are inspected upon each departure. We are not responsible for the opening and closing of subdivision pools.
FIREPLACES
Fireplaces (wood and gas) are closed from April 1 to October 1. Please be aware that we do supply firewood and fire lighting utensils. Do not rearrange gas logs for any reason or a fine will be incurred.
WHAT WE SUPPLY
Mountain Comfort Cabins provides: 1 roll of paper towels, 2 rolls of tissue per bathroom, 2 small soap per bathroom, 2 trash bags per trash can for your convenience. For every full-size bathroom, we provide 4 bath towels, 4 washcloths, and 2 hand towels, shampoo and conditioner, hair dryer. Once you have depleted the provided items, you are responsible for purchasing needed items. All bed linens, towels, kitchenware, and utensils are inventoried upon checkout. We also provide some laundry detergent and dryer sheets. Not all units provide washer/dryer; please view the unit amenities for your cabin or call our office. We provide coffee filters, but you may want to bring charcoal for the grill.
FURNITURE
Place all furniture back in the arrangement in which you found it upon arrival. Do not disconnect any cables or plugs from the television as this may interfere with its working ability. All units are privately owned; not all have phone service. Check amenities list for your unit.
SERVICE CALLS/MAINTENANCE
Our maintenance staff is here to assist you and provide timely service. Emergencies take precedence over non-emergency issues. If a maintenance issue is determined to result from guests, the guests agree to pay for said maintenance. Example: A/C unit freezes up due to guest adjusting thermostat to low, refrigerator freezes due to guest adjusting thermostat, etc. As in any home, appliances, hot tubs, A/C and heating units, cable/satellite, TV/VCR/DVD, fireplaces, etc. may malfunction on occasion. Please report any malfunction immediately. We do not give REFUNDS for any malfunction. To change cabins, a service fee and housekeeping fee will be required. We will make every effort to correct any deficiencies as soon as possible during regular business hours.
ACCOMMODATIONS
All vacation rental units are individually owned. Mountain Comfort Cabin Rentals has no ownership interest. Each property reflects the taste of each owner. We are not responsible for any changes made by the owner in furnishing or amenities. All guests understand they are solely responsible for any property damage, accident, death, injury to any person(s), or loss sustained by any person, including the loss of money, jewelry, and other items of personal property, arising out of or in any way related to a guest's use of the premises. All guests shall inspect and be familiar with the proper use and application of all items in the vacation rental prior to using them. The guests agree to indemnify and hold Mountain Comfort Cabin Rentals and/or the homeowner harmless from all claims, including those of third parties, arising out of or in any way related to a guest's use of the premises or the items of personal property provided therein. All guests assume the risk of injury, death, or other loss related to any recreational activities or use of the premises and will hold the owner and its agents harmless with respect thereto.
